User Legal Agreement

This terms of service is a legal contract between you and SpyFone (www.spyfone.com), governing your use of mobile or web services or mobile or web software ("SpyFone Service") owned, owned, controlled or offered by SpyFone Service.

PLEASE READ CAREFULLY THE FOLLOWING TERMS AND CONDITIONS OF SERVICE. BY USING THE SpyFone SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THE TERMS OF THIS TERMS OF SERVICE. IF YOU DO NOT AGREE TO THIS TERMS OF SERVICE, PLEASE CEASE USING THE SpyFone SERVICES IMMEDIATELY.

LICENSE GRANT

All SpyFone services are licensed to you and not sold. SpyFone grants you a personal, non-exclusive, non-transferable service and non-sub licensable license to use the SpyFone service only for your personal or internal business use. You will retain all ownership rights in User Data that you transfer to SpyFone for data protection.

LEGAL AGREEMENT

You agree to obey all the applicable laws of your country regards to the use of SpyFone software. You must own the smartphone or have written permission from the owner of the smartphone before downloading, installing, activating SpyFone software on that phone. The user of the smartphone must have knowledge that you are viewing their personal data. SpyFone assumes no responsibility if you install, download and activate SpyFone software on a smartphone ("mobile phone", "Cell Phone") without the knowledge and permission of its Legal owner. You agree that SpyFone is not responsible accepts no liability for any misuse or damages. As soon you download, install or active SpyFone service from, you agree to obey all the laws of your country and assume all responsibility of the way you use SpyFone.

Terms and Conditions

YOU UNDERSTAND AND HEREBY ACKNOWLEDGE AND AGREE THAT YOU MAY NOT AND WARRANT THAT YOU WILL NOT:

1. Use the SpyFone Services for any illegal purpose, or in violation of any laws, including, without limitation, laws governing intellectual property, data protection and privacy, and import or export control;

2. Remove, circumvent, disable, damage or otherwise interfere with security-related features of the SpyFone Services, features that prevent or restrict use or copying of any content accessible through the SpyFone Services, or features that enforce limitations on use of the SpyFone Services;

3. Intentionally interfere with or damage operation of the SpyFone Services or any user's enjoyment of them, by any means, including uploading or otherwise disseminating viruses, worms, or other malicious code;

4. Post, store, send, transmit, or disseminate any information or material which infringes any patents, trademarks, trade secrets, copyrights, or any other proprietary or intellectual property rights; or

5. Use any robot, spider, scraper or other automated means to access the SpyFone Services for any purpose without our express written permission or bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the SpyFone Services or modify the SpyFone Services in any manner or form, nor to use modified versions of the SpyFone Services, including (without limitation) for the purpose of obtaining unauthorized access to the SpyFone Services.

6. Sell or transfer or allow another person to access your account password or SpyFone Services account

7. Download, Install or Activate SpyFone on a smartphone that is not owned by you.

8. Breach the federal and government laws of your country by downloading, installing or activating SpyFone Software on someone's smartphone.

9. Collect data using SpyFone software from a smartphone, which is not owned by you without the knowledge and consent of the owner of the smartphone.

Subscriptions

1. To subscribe to the SpyFone service (hereinafter referred to as "the service" or "the SpyFone service"), you will need to place a SpyFone order or make a SpyFone purchase.

2. The service provides the defined products to be ordered by a user. The products' packages depend on your device, the quantity of features you select, and any additional subscription plan options or customer support options you may choose to order.

3. Your SpyFone account may have several subscriptions.

4. When placing your order, you should complete the billing information and the payment method by providing your personal information

5. After you purchase the SpyFone software or SpyFone service, your credentials (including but not limited to your login and password) will be sent to your email so you can access your SpyFone service, including your account and control panel.

6. You should download your private encryption key from your control panel or receive it to the email indicated in your subscription. Keep or remember this private encryption key as it may be required to restore access to your account and subscriptions in the future.

7. You may choose from three different SpyFone subscription options, including 1 month, 3 month, and 12 month plans.

8. You are aware that you may use the software and/or the SpyFone service for more than one target device when purchasing one subscription plan, but you have to reinstall it on your own.

9. Your subscription will automatically renew unless you de-select the auto renew option at least 24 hours prior to the end of your current SpyFone subscription period.

10. If you do not de-select the auto renew option, then your provided payment method will be charged for the next subscription plan period. You can take the auto renew option on or off at any point during your subscription period. Visit your SpyFone control panel or account to alter your automatic renewal preferences.

11. You may never use another user's account without their explicit permission. When creating your account, you must provide us with accurate and complete information.

12. You are exclusively responsible for any activity that occurs on your SpyFone account. It is your responsibility to keep your account access information secure and to prevent unauthorized access to your account by any third parties.

13. You may not share or transfer any SpyFone account, SpyFone software, and/or SpyFone subscription. You are forbidden from disclosing your password to anyone else.

14. You must notify SpyFone immediately of any breach of security or unauthorized use of your account. Notify SpyFone immediately if you believe your account information and/or access credentials may have been compromised.

15. SpyFone will not be liable for any losses caused by any unauthorized use of your account by any third party, unauthorized individual, and/or unauthorized organization.

16. You may interact with the SpyFone service and the SpyFone software through your account dashboard and control panel by changing settings that are made available to you. You are permitted to enable or disable auto renew for your SpyFone subscription.

17. You are responsible for all activities that occur under your SpyFone account.

18. You agree not to create or access a SpyFone account using a false identity or information, or to access an account on behalf of someone other than yourself.

19. You agree not to create an account or use the SpyFone service and/or SpyFone software if your account has been previously removed by SpyFone, or if you have been previously banned from using SpyFone for any reason.

20. You are permitted to cancel any SpyFone account you own at any time. Follow the instructions on the SpyFone website to cancel any account registered to you.

21. If you voluntarily terminate a SpyFone account or allow that account to lapse, then you may reactivate that account at any time through the control panel on the SpyFone website. Accounts terminated by SpyFone for any type of abuse, including without limitation a violation of these ToU, may not be reactivated for any reason. Upon any termination or suspension of the SpyFone service, the monitoring of all devices on which the SpyFone software is installed shall cease, and any information you have submitted on the site or that which is related to your account may no longer be accessed by you.

22. In case you forgot your password to the account, you are permitted to restore access with your private encryption key.

Security

1. SpyFone cares about the integrity and security of your personal information. We will take all reasonable precautions to safeguard customer information, including but not limited to contact information, personally identifiable information (PII), and payment details.

2. You acknowledge that you provide your personal information to the payment provider when placing your order for the SpyFone software and related SpyFone services or subscriptions.

3. SpyFone receives the personal information of a user from the payment provider consisting of the user's ID and email (login). Only the user knows his or her password, and SpyFone and/or the payment provider does not know the user's password.

4. SpyFone uses its database to store your encrypted personal information. SpyFone does not have direct access to this encrypted data.

5. SpyFone is not responsible for any third party data leaks, memory leaks, or other data integrity problems in our databases.

6. You agree that you are obligated to retain the private encryption key provided to you by SpyFone.

7. SpyFone stores the user's login information in our database. The user's password is not stored. SpyFone only stores a hash of the password generated by the md5 hash function from user's passwords.

8. SpyFone does not collect downloaded logs and data from a target device (i.e. a device on which the SpyFone software is installed) in case of an active account older than 3 (three) months. Additionally, SpyFone does not collect downloaded logs and data from a target device with the use of the software in case of an expired account older than 1 (one) month.

9. SpyFone does not store in its database all logs and data downloaded from a target device with the use of the SpyFone software in case of an active account for more than 3 (three) months. Upon the expiry of this period, all information will be deleted. In case of expired accounts, all logs and data downloaded from a target device with the use of the SpyFone software will get deleted with a 1 (one) month period.

10. In case of disclosure of such encrypted data, including any logs, personal information, contact information, and/or payment information, SpyFone will not be held responsible.

11. SpyFone does not control, monitor and/or is not aware of the reason a user exploits the SpyFone software application, and SpyFone may not be held responsible for any such use thereof. It is a user's risk and responsibility to use the software according to the ToU and all applicable documentation. SpyFone is not responsible for any unauthorized use and/or improper access of the SpyFone software.

12. You acknowledge that SpyFone does not encourage its users to exploit the SpyFone service illegally.

VIOLATIONS; TERMINATION

You agree that SpyFone may terminate or suspend your access to the SpyFone Services without prior notice and without liability if such termination or suspension is based on (a) SpyFone good faith belief you have violated any of the terms and conditions of this Agreement, (b) SpyFone determination that you repeatedly infringe or have infringed the copyrights of others, (c) extended periods of inactivity with respect to any of the SpyFone Services or (d) non-payment of any fees owed to SpyFone. These remedies are in addition to any other remedies SpyFone may have at law or in equity.

INDEMNIFICATION; HOLD HARMLESS

You agree to indemnify, defend, and hold harmless SpyFone, its affiliated companies and its suppliers and partners (including, without limitation, SpyFone's wireless carrier partners) from any and all claims, suits, actions, losses, costs, damages and any other liabilities, including attorneys' fees, arising out of or related to (a) your use or misuse of the SpyFone Services, (b) any violation of the rights of any other person or entity by you, or (c) any breach or violation by you of this Agreement. SpyFone reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.

LIMITATION OF LIABILITY AND DAMAGES

TO THE EXTENT PERMITTED BY APPLICABLE LAW, SpyFone OR ITS AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, OR THIRD-PARTY PARTNERS (INCLUDING, WITHOUT LIMITATION, SpyFone'S WIRELESS CARRIER PARTNERS) OR SUPPLIERS WILL NOT BE LIABLE TO YOU FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, RELIANCE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES RELATING TO YOUR USE OF THE SpyFone SERVICES, EVEN IF SpyFone HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION WILL SURVIVE ANY TERMINATION OR EXPIRATION OF THIS AGREEMENT AND WILL APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. IN NO EVENT SHALL SpyFone'S (OR ITS AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR THIRD-PARTY PARTNERS INCLUDING, WITHOUT LIMITATION, SpyFone'S WIRELESS CARRIER PARTNERS') TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THIS AGREEMENT EXCEED THE AMOUNTS PAID BY YOU FOR ACCESSING THE SpyFone SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF YOUR CLAIM OR ONE THOUSAND DOLLARS, WHICHEVER IS GREATER.

RESERVATION OF RIGHTS

The SpyFone Services and all content, visual interfaces, information, graphics, design, compilation, computer code, products, software, trademarks, service marks, trade names and services are the property of SpyFone or its subsidiaries or affiliated companies and/or third-party licensors. Except for the express license granted to you, no right, title, interest or license to the SpyFone Services is granted to you, whether by implication, estoppel or otherwise.

RESTRICTIONS

You acknowledge and agree that you will not: (a) reproduce or attempt to reproduce the SpyFone Software; (b) modify, adapt, translate or create any derivative works of the SpyFone Software or attempt to do the foregoing; (c) attempt to circumvent or disable the SpyFone Software or any technology, features or measures in the SpyFone Software by any means or in any manner; (d) attempt to decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code for the SpyFone Software; (e) distribute, encumber, sell, rent, lease, sublicense, or otherwise transfer, publish or disclose the SpyFone Software to any third party; (f) use for a service bureau or otherwise commercialize or attempt to commercialize use of the SpyFone Software; or (g) remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels in or on the SpyFone Software or used in connection with the SpyFone Software

USER DATA AND LOCATION DATA

The SpyFone Services may allow the submission of content and materials by you (" User Data "), and the hosting, storing, sharing and/or publishing of such User Data. You shall be solely responsible for your own User Data and the consequences of storing or transmitting them.

SpyFone assumes any data that is uploaded using the SpyFone service purchase by you is your data and hence will not be liable for anything to that data.

SpyFone assumes no responsibility whatsoever in connection with or arising from User Data or for actively monitoring User Data for inappropriate or illegal content. SpyFone does not endorse and has no control over the content of User Data submitted by other Users. SpyFone reserves the right to prevent you from submitting User Data and to restrict or remove User Data for any reason at any time. In addition, certain SpyFone Software may use data received or obtained from your wireless device to determine your location ("Location Data "). By using the SpyFone Services, you hereby consent and permit SpyFone to use Location Data in accordance with the terms of our Privacy Policy. SpyFone does not make any representation, warranty or guarantee of accuracy, completeness or timeliness of with respect to any Location Data.

MODIFICATION OF THIS AGREEMENT

SpyFone may modify this Terms of Service from time to time. Any and all changes to this Agreement will be posted on the spyfone.com site, and you agree to be bound by any changes to the Terms of Service when you continue to use the SpyFone Services after those changes are posted.

REFUND POLICY

SpyFone services are bought on subscription basis. In the event you choose to subscribe to SpyFone service, you will be charged through PayPal or BlueSnap. Subject to this Refund Policy condition, user may be eligible to receive a full refund within 14 days from the day of payment, if the cancellation reason is proper and valid. To be clear, you will not be refunded any charges you paid for that subscription period once subscription period expired.

Refund Conditions
SpyFone Software

Subject to the laws of the United States of America and to this refund policy's conditions, you have 14 days as a "cooling off" period. You may be eligible to receive a full refund within 14 days of your purchase as long as refund reasons do not contradict the refund policy conditions outlined below.

1. No refund shall be issued more than 14 days after the purchase date. The claim for refund may apply only to the primary (first) SpyFone subscription.

2. If you purchase additional subscriptions in another order, no refund will be issued for additional subscriptions. The claim for refund only applies to the primary (first) SpyFone subscription.

3. Your refund may be issued only once. If you purchase another SpyFone subscription at a later time, then it will not be subject to the same refund request.

4. No refund will be issued in situations where the user has lost his or her private encryption key, leading to the loss of data, temporary loss of access to the user's control panel, or any other inconveniences for the user.

5. No refund will be issued in situations where a user refuses to reinstall or re-link SpyFone in the event of the performed upgrade of the operating system on the target device.

6. No refund will be issued in case a user's target device is not in compliance with the SpyFone compatibility policy. It is the customer's responsibility to check the compatibility policy prior to purchasing the software.

7. No refund will be issued in cases where the target device has lost connection with its SpyFone subscription due to the absence of internet access, factory resets, or updates to the latest operating system version.

Pre-Monitored Devices

In a situation where a device cannot be provided or found to suit your needs, a complete (100%) refund will be issued. A device will be found 99% of the time that will support your software successfully and safely. In the rare instance the device doesn't work and we insist the device is correct, proof will be required of your statement before a refund is processed.

*For the refund, you MUST contact us first, as different devices have different proof requirements. If these requirements are not met, we or our suppliers with whom we work with may refuse a refund.

No refund can be issued to a user in situations where the reasons for a refund are completely beyond the control of SpyFone. Those reasons include all of the following:

1. Any information about the order provided is incorrect. (Examples are as following and are not limited to; Shipping Address, Email address, and/or other relevant Contact information requested)

2. The phone is hard bricked, meaning an incorrect or improper usage was rendered in order to attempt to fix the device on your own. This can permanently damage the device. If you are not sure of how to support your device, please check with us first.

3. Shipping speed of the device exceeded our stated average turnaround time. In most instances, we are very accurate or even faster with the turnaround times; however, there may be delays if any contingencies arise.

4. Your device was successfully received, but the third-party application or network you wish to use with the phone is not compatible. It is the buyer's responsibility to make sure the device you wish to purchase will be compatible with the network or third-party application you are trying to use.

5. The monitoring application was uninstalled due to a factory reset, in this event the only solution we can provide is to have the monitoring application re-installed remotely. Please note that you will need the SpyFone in your possession for 20-30 minutes with a windows PC and USB cable for the remote session.

6. The target phone is not owned by the user or the user did not receive consent of a target phone owner to install the SpyFone software.

7. The target phone does not have internet access (for example, if the target phone has no money left on its prepaid account, suffers a temporary service interruption, or encounters a roaming-related problem, among other reasons).

8. The phone's carrier operator is changed by the phone's owner or user, leading to a loss of internet connectivity and/or data service, which consequently leads to improper functioning of the SpyFone software.

9. The target phone's operating system was updated.

10. The target phone underwent a factory reset and/or was modified to its original settings.

11. The user does not follow the installation guidelines of the SpyFone customer support team given via email or telephone call.

12. The user does not accept technical assistant and/or refuses to follow the solution provided by our customer support team.

13. The user does not have physical access to the target phone, has forgotten the password to unlock the phone, and/or loses access to the target phone for any other reason.

14. The user did not receive the data that had been saved on a target phone before SpyFone was installed on it. SpyFone may not be able to retrieve data that was on the phone prior to the installation of SpyFone software.

15. The target device is running an unsupported operating system. A number of specific operating systems are not supported by SpyFone. Unsupported operating systems include Windows Phone, BlackBerry 10, Bada, Symbian Belle, and Windows Mobile, among others. Check our compatibility policy for specific information regarding SpyFone mobile operating system compatibility.

16. The user is intending to use SpyFone on more than one target device after purchasing a single subscription plan.

17. Personal reasons (the user has changed his or her mind, made the purchase by mistake, or no longer wishes to use the software, among other reasons).

18. The user is unable and/or unwilling to jailbreak the iPhone or root the Android to unlock SpyFone's advanced features.

19. The user's target phone is not in compliance with the SpyFone compatibility requirements.

20. The SpyFone software was unlinked or damaged by antivirus software, the target device's owner, or other security services.

21. Advanced SpyFone features are not available because a user is unable or unwilling to jailbreak the iPhone or root the Android device. Advanced SpyFone features may include WhatsApp, Skype, and Viber monitoring, among other features.

*If you have an error with the root or are unsure about your application functioning properly, please contact us immediately for support, as our main goal is to support your device.

Please allow up to 7 - 10 business days for the refund to show up on your account.

Pre-Monitored Devices Return Policy

All returned devices must be in its original packaging with the UPC or barcode intact, with all components, manuals, and/or registration card(s) included with no signs of physical damage.

All software issues can be resolved via a remote session within the specified warranty period, if you are unable to perform a remote session due to PC or other limitations you may be required to cover the shipping cost back to our us for servicing.

Defective hardware components will be repaired or replaced within the 90 day warranty period providing that there are no signs of physical/water damage on the device.

Returns may attract a 15% restocking fee.

DISCLAIMER:

SpyFone software is designed for ethical monitoring for parents who wish to monitor their underage children or for employers who wish to monitor their employees with their written consent. The buyer of the SpyFone software must own the smartphone, be a legal guardian or must have consent from their employees granting them permission to monitor before they install and activate the SpyFone software onto the smartphone.

SpyFone software must not be used to 'Stalk' or 'Spy' anyone. SpyFone software must not be used to monitor the smartphone of a spouse, girlfriend, boyfriend, child over 18 without their written consent.

If you attempt to use SpyFone software to monitor a smartphone you do not own or have proper consent to do so by the owner of the smartphone, you may be breaking federal and state laws. In such case we will cooperate with the law officials to full extent.

SpyFone software does not assume any liability for any misuse or damages caused by our SpyFone software. It is the responsibility of the buyer to obey all laws of their country and use SpyFone software legally.

You are taking full responsibility of using SpyFone for legal purposes and are not breaking any federal or state laws. It is the responsibility of the user of SpyFone to ascertain, and obey, all applicable laws in their country in regard to the use of SpyFone. It is the final user's responsibility to follow all the laws in their country and SpyFone will not be held accountable for any illegal use of the product. By downloading and installing SpyFone, you pledge that SpyFone bears no responsibility from here on forth. Logging other people's SMS messages and other phone activity or installing SpyFone on another person's phone without their knowledge can be considered as an illegal activity in your country. It is the user's responsibility to carry out research regarding their country's laws before buying SpyFone. By purchasing, downloading, installing or activating SpyFone, you hereby agree to the above.

Privacy Policy:

It is company policy that our customer databases remain confidential and private. We have not, will not, and won't ever sell names to "spammers" or other parties who would like to use our databases to advertise or solicit their products or services.Your private information is safe with us.

We take all reasonable precautions to protect the privacy of your information. When you submit sensitive information via the SpyFone website, your information is protected online as well as offline.

Wherever we collect sensitive information, that information is encrypted and transmitted to us in a secure way. You can verify this by the presence of a closed lock icon at the bottom of your web browser, or seeing the letters "https" at the beginning of the URL address of the web page.

DATA SECURITY

To ensure the absolute security of your data, we recommend you download your data regularly & delete it from your account. We automatically delete all data that is more that 90 days old. We hold no back up for your private data so deleting your information makes it permanently inaccessible.
